As sustainability continues to reshape the packaging industry, Extended Producer Responsibility (EPR) stands out as a key policy driver. At its core, EPR promotes accountability—requiring producers to take greater responsibility for the full lifecycle of their packaging, including post-consumer impacts.

EPR legislation is progressing rapidly across the United States. States such as California, Colorado, Oregon, Maine, and Minnesota have enacted laws that will affect how packaging is designed, labeled, and managed at end-of-life. Others—like Washington, Maryland, New York, and Illinois—are developing similar programs.
In Washington State, EPR legislation (SB 5284) was recently passed, requiring producers to join a Producer Responsibility Organization (PRO) by January 1, 2026. It establishes a comprehensive recycling framework to be implemented by 2030, prioritizing accessibility, environmental impact, and shared accountability. As a Washington-based company, Portco Packaging is closely monitoring these developments and will continue to share updates and resources to assist our customers.
Although each state’s regulations vary, common themes include material reporting, PRO membership, and funding of recycling systems—typically through annual fees designed to encourage sustainable design. Most programs aim for full transition to recyclable, compostable, or reusable packaging by 2030 or 2032.
